Find a Provider Application Terms and Conditions

Thank you for accessing this online Find a Provider Application (the “Application”). The Application as well as the information contained within the Application (the “Application Information”) is provided solely for the convenience of, and non-commercial use by, members and potential members of the health plans offered by WellCare Health Plans, Inc. and its direct and indirect subsidiaries (collectively “WellCare,” “we” or “us”), providers and potential providers in WellCare’s networks and other interested individuals accessing the Application for a legitimate non-commercial purpose.

By using this Application you are agreeing to the Terms of Use (the “Terms”) set forth below.

1. Changes to these Terms
We reserve the right to change these Terms at any time and without notice. We encourage you to return to these Terms whenever you use this Find a Provider Application in the event they have been revised since your last visit. Your use of the Application constitutes your acceptance of the Terms in effect at that time.

2. Site Usage
The data contained in this Application is proprietary to WellCare and any attempt to download or otherwise access it for a commercial or other pecuniary purpose is strictly prohibited. You are authorized to access and use the Application and Application Information as set forth in these Terms, provided that: (i) your use of Application and information as permitted hereunder is solely for your personal, non-commercial use; (ii) you will not copy, distribute or transfer any portion of the Application or Application information on any media without WellCare’s prior written approval; (iii) you will not alter, adapt or otherwise modify any part of the Application or Application Information other than as may be reasonably necessary to use that part of this website for its intended purpose; and (iv) you will otherwise comply in full with these Terms.

3. No Guarantee of Accuracy
While we take efforts to ensure that the information contained in this Application is accurate, we do not guarantee or warrant that the Application Information contained herein is complete, accurate, up-to-date or error-free. WellCare updates the information contained in this Application on a regular basis. However, updates are not immediate. In addition, providers in our networks are independent contractors. Therefore, the timeliness and accuracy of the information contained in this Application is dependent, in part, on the timeliness and accuracy of the information WellCare receives from its providers. The search functionality also depends on our internal systems and third party technology vendors; system errors or other technological problems can generate erroneous results. In addition, typographical and similar errors can occur from time to time.

Once you have identified a provider through this Application we recommend that you contact the provider directly to verify that the provider accepts your insurance, the provider’s office hours, languages spoken by the provider and any other details about the provider that you may need.

4. Referrals
Many of WellCare’s plans require a member to obtain a referral to see a specialist or similar provider other than the member’s primary care provider (except in the case of emergencies and certain other circumstances). The Find a Provider Application simply provides results based on search criteria; the inclusion of a provider in a list of search results does not mean that services from that provider would be covered by your plan without a referral. Please refer to your plan documents to determine whether you will need a referral to see a specialist or other particular provider.

5. No Endorsement
WellCare does not endorse or recommend the services of any particular provider contained in this Find a Provider Application.

6. Not Medical Advice
WellCare is not licensed as a physician or to otherwise render medical advice. The providers in our network are independent contractors and each is responsible for the services he or she provides to you.

7. Availability
Our systems are shut down from time to time for routine maintenance and for system upgrades. In addition, our systems may go down unexpectedly due to weather conditions, problems with telecommunications or similar circumstances. There will therefore be times at which the Find a Provider Application is not available.

8. Improper Use of the Application
You agree that you will not do any of the following:

  • Introduce or attempt to introduce a Trojan horse, worm, virus, spider, robot, files, programs, or other malicious and/or foreign code into this Application designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
  • Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted to or through the Application.
  • Use the Application to collect or store personal data about others.
  • Use the Application in a manner that intentionally or unintentionally violates any applicable local, state, national or international law.
  • Use the Application or Application Information for any commercial or pecuniary purpose.
  • Use the Application in any manner that is harmful to others.

9. Security
You shall not violate or attempt to violate the security of the Application or any websites operated by WellCare. Violations of system or network security may result in civil or criminal liability. WellCare reserves the right to investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who have participated in such violations.

10. Cookies
Certain functionality of the Find a Provider Application relies on “cookies.” Cookies are small pieces of code placed on your computer system by the Application. For example, you will not be able to save a search performed in the Application unless cookies are enabled on your system.

11. Third-Party Links
The Application may provide, or third parties may provide, links to other websites or resources. Because WellCare has no control over such sites or resources, you acknowledge and agree that WellCare is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. WellCare assumes no responsibility for the content, privacy policies or practices by such third-party websites. By using this Application, you expressly waive any rights, claims or liability against WellCare from your use of any third-party website.

12. Indemnity
You agree to indemnify and hold WellCare and its agents and licensors harmless from any claim or demand, including reasonable attorneys fees, made by any third party due to or arising out of your use of the Application and/or the Application Information, your violation of these Terms, or your violation of any rights of another.

13. Termination
We reserve the right to modify, discontinue, temporarily or permanently, this Application, or any part thereof, at any time, with or without notice. You further agree that WellCare, in its sole discretion, may terminate or prevent your use of the Application, for any reason, if WellCare believes that you have violated or acted inconsistently with the letter and spirit of these Terms. You agree that any termination of your access to the Application under any provision of these Terms may be effected without prior notice, and acknowledge and agree that WellCare may bar any further access to the Application. Further, you agree that WellCare shall not be liable to you or any third-party for any termination of access to the Application.

14. WARRANTY DISCLAIMER
YOUR USE OF THE APPLICATION AND APPLICATION INFORMATION IS AT YOUR SOLE RISK. WELLCARE MAKES NO WARRANTY THAT THE APPLICATION WILL MEET YOUR REQUIREMENTS. ALL APPLICATION INFORMATION IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS, STATUTORY OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT OR NONMISAPPROPRIATION OF INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY, TITLE, CUSTOM, TRADE, QUIET ENJOYMENT, ACCURACY OF INFORMATION CONTENT, OR SYSTEM INTEGRATION. WELLCARE DOES NOT WARRANT THAT THE APPLICATION WILL BE AVAILABLE OR OPERATE IN AN UNINTERRUPTED, ERROR-FREE OR COMPLETELY SECURE MANNER OR THAT ERRORS OR DEFECTS WILL BE CORRECTED.

15. LIMITATION OF LIABILITY
The information provided to you by this Find a Provider Application is provided to you for your convenience.

UNDER NO CIRCUMSTANCES SHALL WELLCARE BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS OR USE OF THE APPLICATION. YOUR SOLE AND EXCLUSIVE REMEDY HEREUNDER SHALL BE FOR YOU TO DISCONTINUE YOUR USE OF THE APPLICATION. IN THE EVENT THAT THIS LIMITATION IS SUPERSEDED BY APPLICABLE LAW, THE MAXIMUM DAMAGES YOU OBTAIN AGAINST WELLCARE SHALL BE LIMITED TO FUNDS PAID TO WELLCARE THROUGH THIS APPLICATION OR ONE-HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

16. Limited Time to Bring Claim
You and WellCare agree that any cause of action arising out of or related to the Application or any Application Information must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

17. Conflicting Laws and Regulations
In the event any law or regulation conflicts with these Terms then the applicable law or regulation will take precedence over these Terms. However, these Terms or use will continue to apply to the extent not in conflict with such law or regulation.

18. General Terms
These Terms constitute the entire agreement between you and WellCare relating to your use of our Application and Application Information.

The Terms and the relationship between you and WellCare shall be governed by the laws of the State of Florida without regard to any conflict of law provisions. You and WellCare agree to the personal and exclusive jurisdiction of the courts located within Florida, in all disputes arising out of or relating to these Terms, the Application and the Application Information. The failure of WellCare to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. Should any part of the Terms be declared invalid or unenforceable by a court of competent jurisdiction, this shall not affect the validity of any remaining portion and such remaining portion shall remain in full force and effect as if the invalid portion of the Terms had been eliminated.

On April 22, 2024, UnitedHealth Group issued a press release, providing an update on the Change Healthcare cybersecurity incident that occurred on Feb. 21, 2024.
